If I wanted to make a fps game with lots of different guns and/or vehicles, should i make up my own names for the guns, vehicles etc... or can i use a name like ak-47 or m16 for a weapon or maybe nissan or bmw for a car.

If you are using any brand names in a game, you could well be sued.

I worked on a Lotus game once and even though we paid a lot of money to use their brand, we weren't allowed to let the car be damaged in the game.

You ran into a wall at 120 mph , the car didn't even get a scratch.

why the hell is that?!? are they touchy about their work of technical art?
you used to be able to fit a game on a disk, then you used to be able to fit a game on a cd, then you used to be able to fit a game on a dvd, now you can barely fit one on your harddrive.

man you wouldn't believe how touchy.

I once had to drive to Dundee from Sheffield to see a client because they insisted that the colour of a characters jacket was the wrong shade of red.

I turned on their computer, adjust the colour balance on their TV, and it was perfect.

They wouldn't allow us to release the game as they said the colour was wrong.

Another client wouldn't allow me to have a hair dryer melting a cube of ice because the water may get into the electrics and start a fire. IT'S A GAME!

Indeed, if you want to use name brands expect some pretty serious trademark license negotiations with large companies. While this may be a "fun" exercise in IP management, it can be overcome. Check out: http://autoclubrevolution.com/.
